Turin, No. 735673 | Company Register of Turin, No. 05787820017, hereinafter referred to as “Fidia”, which determines the purposes and means of the processing of personal data collected. Personal data means any information relating to an identified or identifiable natural person; hereinafter referred to as the “data subject”.
Processing means any operation or set of operations which is performed upon personal data or sets of personal data, whether or not by automatic means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction.
Data provided to Fidia via registration for the newsletter will be processed in full compliance with European Regulation 679/2016 and for this purpose, the data controller provides the data subject with the following information.

Legal basis and the purposes of the processing

The personal data provided by the data subject will be processed by Fidia for the purpose of providing the required newsletter service free of charge and concerning company products and the use of same, as well as information on new products and any special offers in the sector.
The legal basis for processing is to be found in the consent of the data subject who, according to that set down by law, shall provide consent to processing his or her personal data, freely given, specific, informed and beyond any doubt of his or her agreement to this data processing, via a declaration or positive action. The data subject is required to express explicit consent to profiling, consisting in the use of the following information: “name”, “surname”, “company”, “nationality”, “user type”, “the language in which he or she wishes to receive the newsletter”, according to which the specific newsletter will be sent.
The legal basis for processing is to be found in the legitimate interests of Fidia, in case of use, for the purpose of the direct sale of its products or services, of email details as provided by the data subject, within the context of a previous sale of a similar product or service.
In this latter case, the legitimate interest of Fidia is represented by the wish to inform the customer on its activities and a fair balance between the rights of the data subject and controller, is carried out directly by the legislator (implementation of directive 2002/58) for which Fidia considers in this case to be able to depend on this legal basis as a condition for the legitimacy of processing.
For all of the purposes listed, personal data will be processed solely as communicated by the data subject, in order to reduce the invasiveness of processing to a minimum, taking into account the reasonable expectations of same with regard to the information shared with Fidia.
In any case, the data subject may enforce his or her right to oppose or to withdraw consent using the methods stated below (Withdrawal of consent and right of objection).

Processing methods

The newsletter service, data collection and profiling will take place using computerised means. Data will be stored in an archive belonging to the data controller and created to facilitate the correct processing of personal data with regard to the type, purpose and duration of processing, the rights of the data subjects and in particular, those relevant to the rights of consent withdrawal and the right of objection. Failure to communicate information required in the form, or failure to consent to processing for the purpose of sending the newsletter, will make it impossible for Fidia to provide the data subject with this service.

Recipients

Personal data collected during registration will be processed internally by Fidia using authorised personnel or persons who process personal data on behalf of Fidia by contract, as data processors, and implementing the due guarantees to protect personal data.
In any case, the data will in no way be transferred to any country outside the European Union.

Duration of Processing

Personal data will be stored exclusively for the period in which the newsletter service will be active and for as long as the data subject does not object to the sending of the newsletter. Information concerning consent cannot be stored for longer than five years after the service provided ceases to be.

Data Subject’s Rights

The data subject may exercise the following rights with regard to Fidia:

• Confirmation of the existence of personal data concerning him or her, and communication of such data in intelligible form.
• Obtain erasure and blocking.
• Obtain updates, corrections and integrations to his or her data.
• In cases envisaged by law, to receive, in a structured, commonly used format that can be easily read by an automatic device, the personal data provided.
• Right of withdrawal of consent and the right to objection.

Withdrawal of consent and the right to objection

Specifically, Fidia would like to inform the data subject that on the occasion of sending each newsletter, he or she will be informed of the possibility to object to processing and to withdraw consent, simply by clicking on the UNSUBSCRIBE link at the bottom of the email.

Exercise of rights

The above rights can be exercised by sending a request to the following email: privacy@fidia.it In the same way, any information or clarification on this policy statement or on the rights of the data subject, can be obtained from the same email address.

Complaints and jurisdiction

The data subject who considers the processing of his or her data to be in breach of personal data protection laws has the right to submit a claim to the Privacy Authority or to another member state of the EU in which he or she habitually works or resides.
The data subject has the right to take legal action in the event he or she considers there to have been a breach of his or her rights following processing.
